Welcome to Live Vital, LLC. By accessing or using our website, telehealth platform, and medical services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and Live Vital, LLC. We reserve the right to modify these Terms at any time, and your continued use of the Services constitutes acceptance of any modifications.

Live Vital, LLC provides telehealth services including virtual consultations, lab work coordination, prescription services, and ongoing health optimization programs. Our services are provided by licensed healthcare professionals.

Our Services are intended for adults 18 years of age or older. By using our Services, you represent that you are at least 18 years old and legally capable of entering into binding contracts.

The information provided through our Services is for informational and treatment purposes only and should not be considered a substitute for in-person medical care when appropriate. Our telehealth services are designed to complement, not replace, traditional healthcare.

In case of a medical emergency, call 911 or go to your nearest emergency room. Our Services are not intended for emergency medical situations.

Individual results from our treatments vary. We make no guarantees regarding specific health outcomes.

Our telehealth services are available to residents of Utah and patients nationwide where telehealth is permitted. By using our Services, you represent that you are located in a state where we are authorized to provide telehealth services.

You must provide accurate and complete information during registration and maintain the accuracy of your information. Providing false information may result in termination of your account.

To access certain features of our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

Our Services are cash-pay. We do not bill insurance directly, but can provide superbills for you to submit to your insurance company for potential reimbursement.

Payment is due at the time of service unless otherwise agreed. You authorize us to charge your provided payment method for all fees associated with your use of the Services.

Prices for our Services are subject to change. We will provide notice of any price changes before they take effect.

You may cancel at any time. Cancellation will be effective at the end of your current billing period.

Refunds for consultations are provided at our discretion. Medications and lab work are generally non-refundable once ordered or dispensed.

Please contact us to discuss any concerns about charges or to request a refund.

You agree not to use our Services for any unlawful purpose or in violation of these Terms. Prohibited conduct includes but is not limited to:

Providing false or misleading information to obtain prescriptions or medical services.

Attempting to obtain controlled substances inappropriately or for purposes other than legitimate medical treatment.

Sharing your account or medications with others.

Interfering with or disrupting the Services or servers.

Attempting to gain unauthorized access to any portion of the Services.

All content on our website and platform, including text, graphics, logos, and software, is the property of Live Vital, LLC or our licensors and is protected by intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

To the maximum extent permitted by law, Live Vital, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Our total liability for any claims arising from or related to the Services shall not exceed the amount you paid for the Services in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Live Vital, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Services shall be resolved in the state or federal courts located in Utah.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

By providing your mobile phone number and opting in, you consent to receive text messages (SMS/MMS) from Live Vital. Message types may include appointment and order confirmations, appointment reminders, treatment and shipment updates, customer support and account notifications, and, where you have separately opted in, promotional and marketing messages. Consent to receive marketing text messages is not a condition of purchasing any products or services.

Message frequency varies based on your interactions with us and the services you use.

Message and data rates may apply. Any charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging plan.

For help, reply HELP or INFO to any message, or contact us at support@livevital.io or (435) 610-7593. Our automated help response is: "Hello, thanks for texting Live Vital. We are currently closed. A member of our team will respond to your message upon our return or you can support@livevital.io. Thank you! Reply HELP for help."

To opt out and stop receiving text messages at any time, reply STOP (or CANCEL, END, OPTOUT, QUIT, REVOKE, STOPALL, or UNSUBSCRIBE) to any message. You will receive the following confirmation: "You have successfully been unsubscribed. You will not receive any more messages from Live Vital. Reply START to resubscribe." After opting out, you will not receive further text messages from us unless you opt back in.

To opt back in, reply START (or UNSTOP or YES) to resubscribe. You will receive the following confirmation: "You have successfully been re-subscribed to messages from Live Vital. Reply HELP for help. Reply STOP to unsubscribe. Msg&Data Rates May Apply. Message frequency varies."

Text messaging originator opt-in data and consent information will not be shared with any third parties, excluding aggregators and providers of the Text Message services. For more information about how we handle your information, please review our Privacy Policy.
